  2. GENERAL INFORMATION The Controller hereby assures that it takes all necessary precautions to protect the rights and interests of individuals whose personal data is processed in connection with the use of the Controller's website. The Controller guarantees that the data collected by us is:
    1. processed exclusively for the purpose of fulfilling specific goals based on applicable law, in particular the General Data Protection Regulation (GDPR) and the Personal Data Protection Act,
    2. processed exclusively on the basis of the legal basis provided by the GDPR,
    3. stored for no longer than is necessary to achieve the specific purpose of processing.
  3. DEFINITIONS Whenever the term written in capital letters is used in the content of this Privacy Policy, it should be understood as follows:
    1. Controller – Veles Productions Sp. z o o, 10 Jubilerska Street, 04-190 Warsaw, Poland.
    2. Personal Data means information about an identified or identifiable natural person (the person to whom the data relates); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
    3. Anonymous Information information about the User regarding the use of the website by the User, provided to the Controller through various tools used by the Controller, such as Google Analytics. However, due to the type of information collected, the Controller is not able to assign it to a specific user.
    4. Processing of Personal Data means any operation or set of operations performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
    5. Profiling means any form of automated processing of Personal Data consisting of the use of Personal Data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.
    6. GDPR Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation [hereinafter referred to as the Regulation or GDPR]).
    7. Service – means the web page, application or service under which the Controller operates the internet service operating in the domain velesproductions.com.
    8. Device – means an electronic device through which the User accesses the Service.
    9. User – means a natural person using the Service.
  4. LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA Your Personal Data may be processed by the Administrator for the following purposes:
    1. Communication with the User of the Service – which constitutes a legally justified interest of the Administrator – on the basis of Article 6(1)(f) of the GDPR,
    2. To investigate or defend against claims, which constitutes a legally justified interest of the Administrator – on the basis of Article 6(1)(f) of the GDPR,
    3. To inform about job offers and to collect application documents as part of recruitment processes – on the basis of Article 6(1)(b) of the GDPR i.e. taking action leading to the conclusion of a contract and on the basis of the User's consent – on the basis of Article 6(1)(a) of the GDPR,
    4. Adapting and developing the functionality of the Service, including its structure and content, to the individual needs of Users and maintaining the security and quality of services provided by the Service using data collecting and processing technologies, such as cookies, including through the use of monitoring mechanisms during the use of the website – on the basis of the legitimate interest of the Administrator and the consent of the User – on the basis of Article 6(1)(a) and (f) of the GDPR.     5. Carrying out analytical and statistical activities using Anonymous Information – on the basis of Article 6(1)(f) of the GDPR. More information can be found in our Cookies policy.
    6. Creating archives in the event that the Administrator has a need to defend, establish or pursue claims by or against the User or third parties – on the basis of Article 6(1)(f) of the GDPR,
  5. CATEGORIES OF PROCESSED PERSONAL DATA WITH A DESCRIPTION OF THE METHOD OF PROCESSING
    1. For the purposes of communication with the User, the Administrator processes in particular such Personal Data as: name and surname, telephone number, e-mail address and language in which the User wishes to communicate with the Administrator. In addition, other Personal Data provided by the User in the content of the correspondence is also processed. Providing this Personal Data is voluntary in this respect, however it is necessary to contact the Administrator and be able to later service the correspondence by the Administrator. The Administrator indicates that in order to ensure the possibility of proving certain facts in the future, he reserves the right to archive the history of the correspondence with each User. In this respect, the User may request the Administrator to provide him with the archived correspondence history and delete it.
    2. For the purposes of the recruitment process, the Administrator processes in particular the following Personal Data of the candidates: name and surname, date of birth, contact details, information about education, professional competences and previous experience, and other information provided directly by the candidate in the application documents.
    3. In order to optimize the Service, introduce new functionalities and service the Service, the Administrator undertakes a number of analytical and statistical activities using Anonymous Information and cookies provided by certain tools such as Google Analytics. The Administrator is unable to provide the User with access to Anonymous Information because, due to the level of their generality, he is unable to assign them to a specific User.   6. PERIOD OF STORAGE OF DATA
    1. Personal Data of the User processed for the purposes of the recruitment process will be processed until the candidate is selected for the position specified in the advertisement. In the event of consent to the retention of application documents for future recruitment processes, the data will be stored for 12 months from the date of the candidate's consent to their further processing for future recruitment.
    2. Personal Data of the User processed for the purposes of communication with the User and correspondence service will be processed until the communication with the User is finished, unless, due to the need to prove the course of the correspondence in the future, it is necessary to archive it. In such cases, the Administrator is unable to determine the period for which the correspondence will be archived.
    3. Personal Data related to the archive created by the Administrator will be processed until they become obsolete.
    4. Personal Data related to the archive created by the Administrator will be processed until their usefulness is lost.
  7. RECIPIENTS OF PERSONAL DATA
    1. Your personal data may be disclosed to:
      1. the hosting provider to whose servers the User's Personal Data are stored,
      2. legal service providers associated with the Administrator's activity,
      3. IT service providers associated with the Administrator's activity,
      4. other than those indicated above entities that are entitled to obtain information related to the activity conducted by the Administrator, which may also include Personal Data,
      5. subcontractors, in particular entities providing and maintaining selected systems and IT solutions,
      6. tax offices and bodies or institutions entitled to access data on the basis of the law, in particular such as courts, prosecutors, police and security services.
    2. The User's Personal Data may be transferred outside the European Economic Area. In connection with the use by the Administrator of tools provided by entities storing Personal Data on servers located in third countries, including in particular in the USA. Such transfer of the User's Personal Data will then be made on the basis of standard data protection clauses adopted by the European Commission, ensuring an appropriate level of protection in terms of privacy and rights and freedoms of individuals to whom they relate.
  8. INFORMATION ABOUT YOUR RIGHTS
    1. In connection with the processing of the User's Personal Data by the Administrator, the User is entitled to the following rights:
      1. Right of access to Personal Data – The User is entitled to obtain from the Administrator a confirmation whether its Personal Data is processed and in the event of their processing, it is entitled to access information relating to the details of their processing, including in particular what is the purpose of processing and what categories of processing are taking place. The User also has the right to request the delivery of copies of Personal Data processed.
      2. Right to rectify processed Personal Data – The User has the right to rectify incorrect Personal Data. In addition, it also has the right to demand the replacement, supplement or removal of incorrect or incorrect information regarding its Personal Data.
      3. Right to delete User's Personal Data (right to be forgotten) – it is entitled to the User exclusively in the case of the use of the right to delete Personal Data and exclusively in situations where the Administrator does not have another legal basis for further processing of them.
      4. Right to limit the processing of Personal Data to a specific purpose – in the event that in the opinion of the User the Personal Data held by the Administrator is processed in an incorrect or unjustified manner, the User has the right to request the restriction of the processing of his Personal Data to the storage or to the performance of agreed actions with the User.
      5. Right to transfer Personal Data – The User has the right to receive the Personal Data provided to the Administrator in a structured, commonly used format. In addition, it has the right to send the received data to another administrator. The User also has the right to request that his Personal Data be sent directly by the Administrator to another administrator, if it is technically possible.
      6. Right to object – The User is entitled to object to the processing of his Personal Data by the Administrator on the basis of a legally justified interest of the Administrator.
      7. Withdrawal of consent to the processing of Personal Data – The User has the right at any time to withdraw the previously given consent to the processing of his Personal Data. Withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of this consent before its withdrawal.
      8. Right to lodge a complaint with the competent supervisory authority – in the event of considering that the Administrator processes Personal Data contrary to the applicable law, the User may lodge a complaint with the President of the Office for Personal Data Protection (address: President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw). In the event of wishing to use the rights described above, the User is obliged to contact the Administrator in writing at the address of the Administrator or by e-mail at the e-mail address: gdpr@velesproductions.com.
  9. INFORMATION ABOUT AUTOMATED DECISION-MAKING, INCLUDING PROFILING The User's Personal Data will not be profiled.
  10. PERSONAL DATA SECURITY The Administrator applies appropriately selected organizational and technical measures aimed at ensuring certain security standards in the processing of Personal Data by it. The protection of Personal Data is ensured by the use of specific systems and procedures designed to protect the Personal Data processed from their disclosure to unauthorized persons. In addition, the Personal Data obtained by the Administrator are stored in computer systems to which access is strictly limited.
